Terms and Conditions for Tullana Company E-Commerce Platform

These Terms and Conditions (“Terms”) govern your access to and use of the Tullana mobile application (the “App”) and website (collectively, the “Platform”), operated by Tullana Company, a company registered in Kuwait under Commercial Registration No. [488950]. The Platform facilitates the online sale and purchase of beauty products, clothing, and accessories.

By accessing or using the Platform, placing an order, or creating an account, you agree to be bound by these Terms, which form a legally binding agreement between you and Tullana Company in accordance with Kuwait Law No. 20 of 2014 Concerning Electronic Transactions and relevant consumer protection regulations. If you do not agree to these Terms, you must not use the Platform.

These Terms incorporate by reference our Privacy Policy, which details how we handle your personal data in compliance with Kuwait Regulation No. 42/2021 on the Protection of Personal Data Privacy and other applicable laws.

1. Eligibility and Account Registration

  You must be at least 18 years old or the age of legal majority in Kuwait to use the Platform. By using the Platform, you represent that you meet this requirement.

  To make purchases, you may need to create an account by providing accurate information, including your name, email address, phone number, and delivery address. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account.

  We reserve the right to suspend or terminate your account if we suspect fraudulent, unauthorized, or illegal activity, or if you violate these Terms.

2. Product Descriptions and Availability

  All beauty products, clothing, and accessories listed on the Platform are described as accurately as possible, including ingredients, materials, sizes, and colors. However, slight variations may occur due to manufacturing or display differences.

  Beauty products comply with mandatory Gulf Cooperation Council (GCC) Standardization Organization (GSO) standards, as required under Kuwaiti regulations for cosmetics and personal care items. We ensure that products do not contain prohibited ingredients and meet safety and quality requirements set by the Ministry of Health.

  Clothing and accessories adhere to general consumer safety standards under Kuwaiti commercial laws.

  Product availability is subject to stock levels. We reserve the right to limit quantities or cancel orders if items are out of stock. In such cases, we will notify you and provide a full refund for unavailable items.

3. Pricing and Payment

  All prices are listed in Kuwaiti Dinars (KWD) or other GCC countries currency, and include applicable taxes, unless otherwise stated. Prices do not include shipping fees, which will be calculated at checkout based on your delivery location within Kuwait or internationally (if applicable).

  We accept payments via secure electronic methods, including credit/debit cards and other approved gateways, in compliance with Kuwait Law No. 20 of 2014 on electronic transactions. All payments are processed securely, and we do not store your payment details.

  You authorize us to charge your selected payment method for the total amount, including any applicable fees. In case of payment disputes, we will handle them in accordance with Kuwaiti consumer protection laws.

4. Orders and Confirmation

  Placing an order constitutes an offer to purchase, which we may accept or reject. Orders are confirmed via electronic message (email or in-app notification), forming a binding e-contract under Kuwait Law No. 20 of 2014.

  We reserve the right to cancel orders due to pricing errors, technical issues, or suspected fraud. If canceled, you will receive a full refund.

5. Shipping and Delivery

  We deliver within Kuwait and to all GCC countries. Delivery times are estimates and may vary due to factors beyond our control, such as customs delays for international shipments.

  Risk of loss transfers to you upon delivery. You are responsible for providing accurate delivery information. If delivery fails due to incorrect details, additional fees may apply.

  Shipping fees are non-refundable unless the error is ours.

6. Returns, Refunds, and Exchanges

  In line with Kuwaiti consumer protection regulations, including provisions under the Draft Digital Commerce Law and general consumer rights, you may return or exchange eligible items within 14 days of delivery if they are unused, in original packaging, and accompanied by proof of purchase.

  Beauty products may not be returnable if opened, due to hygiene reasons, unless defective. Clothing and accessories can be returned if they do not match the description or are faulty.

  Defective or damaged items will be replaced or refunded at our discretion. Refunds will be processed to your original payment method within, 7-10 business days.

  We do not accept returns for customized or personalized items unless faulty.

7. Prohibited Conduct

  You agree not to use the Platform for any unlawful purpose, including violating Kuwait Law No. 63 of 2015 on Combating Cyber Crimes.

  Misleading advertisements or unauthorized use of trademarks are prohibited, as per electronic advertising regulations.

  You must not attempt to interfere with the Platform’s security or functionality.

8. Intellectual Property

  All content on the Platform, including logos, images, and descriptions, is owned by Tullana Company or our licensors and protected under Kuwaiti intellectual property laws.

  You are granted a limited license to access and use the content for personal shopping purposes only.

9. Privacy and Data Protection

  We collect and process your personal data in accordance with our Privacy Policy and Kuwait Regulation No. 42/2021. We prohibit unauthorized collection, use, or dissemination of personal data.

  By using the Platform, you consent to electronic communications and data processing for order fulfillment and marketing (with opt-out options).

10. Limitation of Liability

  To the extent permitted by Kuwaiti law, we are not liable for indirect, incidental, or consequential damages arising from your use of the Platform or products.

  Our total liability for any claim shall not exceed the amount paid for the relevant order.

  We disclaim warranties beyond those required by consumer protection laws, such as fitness for purpose and non-infringement.

11. Force Majeure

  We are not liable for delays or failures due to events beyond our control, including natural disasters, strikes, or government actions.

2. Governing Law and Dispute Resolution

  These Terms are governed by the laws of the State of Kuwait, including Law No. 20 of 2014 and applicable commercial and consumer protection laws.

  Any disputes shall be resolved amicably. If unresolved, they shall be submitted to the competent courts in Kuwait City.

  For consumer disputes, you may also contact the Ministry of Commerce and Industry’s Consumer Protection Department.

13. Amendments

  We may update these Terms at any time. Changes will be posted on the Platform, and continued use constitutes acceptance. Significant changes will be notified electronically.
